Subpoena to an insurer seeking docs to test its refusal

The documents or things you must produce are as follows ...Insurance is a contract under which the insurer promises to compensate the insured if the insured suffers a defined type of loss - such as fire damage, property theft, sickness, and so forth. The terms of the contract are found in the insurance policy. After these losses occur, insurers sometime annoy claimants by offering a sum of compensation that the insured thinks is inadequate. Less frequently, insurers annoy claimants even more, by denying an insurance claim altogether, on the basis that the claimant did not give full disclosure when applying for insurance, or that the claimant has not "acted in utmost good faith". When an insurance claim is denied altogether the insured might sue the insurer under the contract of insurance. The insured often pleads in defence that it was "entitled to avoid the contract". Some of these documents might test the insurer's position that with full disclosure by the insured they would not have offered insurance cover in the first place.
