A statutory declaration (NSW) for inclusion in the RFT to be filled in by a tenderer who is a single corporation and signed by an officer authorised by the Board under an Instrument of Delegation. It is for use in the special case where two tenderers have openly colluded to independently bid for and supply separate parts of the tender, the sum of which meets or exceeds the requirements, and who wish to be considered concurrently for the tender. It contains declarations on all the significant rules for disqualification, such as collusive tendering, unsuccessful tenderers’ kick-backs, conflicts of interest, unlawful inducements, etc. New South Wales State law.
