55422 Contract - landscape design - hourly rate upfront backout

This Service Contract is for a contractor to work on a landscape design to go to tender, assist in awarding the tender, and assist in project management; to be completed by a given time (the 'term') and to be paid a set fee for a given number of hours within that term. It requires an initial payment to get the job under way and has a 'backout clause' which allows the Client to cancel within 30 days, but, after this date, both sides are committed to completing the job as agreed. The contract contains specific clauses related to landscape design, including rights to own and dispose of the completed land without interest by the Contractor and copyright of the design documents and suggested appendices containing a simple 12 step project plan in 4 stages. There is specific reference only to federal law and therefore can be used in any State. This includes reference to A New Tax System (Goods and Services Tax) Act 1999 (Cth), Acts Interpretation Act 1901 (Cth), Privacy Act 1988 (Cth), the Uniform Consumer Credit Code, Trade Practices Act 1974 (Cth) and Financial Transaction Reports Act 1988 (Cth). This Service Contract is for a contractor to work on a landscape design to go to tender, assist in awarding the tender, and assist in project management; initial services to be completed by a given time (the 'initial term') and to be paid by a set fee, followed by a percentage of the final contract sum following award of tender, a percentage that changes depending upon the complexity and size of the resultant contract. This contract requires an initial payment to get the job under way and has a 'backout clause' which allows the Client to cancel within 30 days, but, after this date, both sides are committed to completing the job as agreed. The contract contains specific clauses related to landscape design, including rights to own and dispose of the completed land without interest by the Contractor and copyright of the design documents and suggested appendices containing a simple 12 step project plan in 5 stages, two of which vary according to the complexity of the project. This contract makes specific reference only to federal law and therefore can be used in any State.
