A commercial lease designed for a shop in which the landlord provides a tenant with a cash incentive payment to enter into the lease. The tenant remits GST. The landlord claims an input tax credit. Australian legal agreement.

52317 Commercial Lease - shop - fit-out by tenant as agent

A commercial lease designed for a shop in which the landlord provides a tenant with a fit-out incentive to enter into the lease; the tenant undertakes the fit-out as agent for the landlord, thereby protecting the landlord's right to an input tax credit. Australian legal agreement.

48057 Commercial Lease - shop - fit-out by the landlord

A commercial lease designed for a shop in which the landlord provides a tenant incentive to enter into the lease by offering to fit-out the shop. The landlord carries out the work and retains ownership of the fit-out. Australian legal agreement.

25698 Deed of Surrender of Lease

New. A lease is a right of exclusive occupancy of another's land, for a defined period. The landowner, the "landlord" sells its right of occupancy to the "tenant" in consideration for a fee, usually regular payments of rent. When the parties enter the original lease, a term of the lease is normally defined, and the tenant is normally obliged to pay rent for that entire period.

Sometimes the landlord will want the tenant to leave before the term is up. This Deed is an Agreement that the tenant surrender the lease, in return for a payment from the landlord for doing so, in the States/Territories of NSW, Victoria, South Australia, Western Australia, Northern Territory and the ACT.

Sometimes however the tenant will pay for the privilege of quitting early. In this situation, the template should be amended so that the fee for the early surrender of the lease is paid by the tenant to the landlord.

In either case the Deed should spell out the entire agreement of the parties, including the agreed obligations of who will remove tenant's fixtures, who will pay water rates for what period, and so on. (L-9985)

20859 NSW - Lease Commercial - Single property

A commercial lease designed for a single property (one that does not involve other tenancies). This is a very detailed and legally precise lease. It assumes a high degree of equality between the lessor and the lessee (i.e. it is not prepared in favour of the lessor as many leases are). It is very clear on who is reponsible for what costs. The landlord covers municipal rates, water and sewerage rates and land taxes. It assumes the term of lease to be up to three years. It allows for a change of rent over the term of the lease. It includes an inventory of fixtures. It includes an attached list of special conditions. This particular example is a deed between a company (as lessor) and another company (as lessee) but it could be signed off in ten different ways see Basic Deeds. 81564 NSW - Lease Commercial - amendment

Free document. Simple amendment to the lease. In this simple note the end of lease is brought forward, placing the tenant on a month by month basis with all other conditions remaining unchanged. (S-2004)

48309 NSW - Lease Shop - Retail - fit-out by landlord(single shop)

A retail shop lease under Retail Leases Act 1994 in the State of New South Wales, designed for a shop that is not in a shopping centre, in which the landlord provides a tenant incentive to enter into the lease by offering to fit-out the shop. This template makes reference to and should be accompanied by Lessor and Lessee Disclosure Statements. The landlord carries out the work and retains ownership of the fit-out. Australian legal agreement. (S-2002)

40954 NSW - Lease Shop - disclosure statements (lessor and lessee)

The Lessor and Lessee disclosure statements required in NSW for lease of a retail shop under the Retail Leases Act 1994. It includes all the information required by Schedule 2 of the Act and some additional information related to the responsibility for fitout and refurbishment for taxation purposes. It needs to be given by the Lessor/Landlord to the Lessee/Tenant at least seven days before the signing of the Lease. Care must be taken to include all representations made to the prospective tenant in this document and for the tenant to ensure that all such representations, including exclusivity if the shop is in a shopping centre, are included here before signing the lease. It contains an appendix outlining retail shop business classifications as per Schedule 1 of the Act. (S-2003)
