Termination Agreement
An agreement in NSW, Victoria, QLD, Tasmania, ACT and NT between partners who have been cohabiting and living in a Domestic Relationship and who have now separated and wish now to agree the terms of this separation, known as a Termination Agreement, to be final and binding and preclude either party seeking property orders from a Court.
Recent changes to the Family Law Act have empowered the Family Court to make orders concerning the property of parties to a de facto relationship in a "participating jurisdiction" that broke down after 1 March 2009. The Act also provides that the separated parties can agree to resolve their property isses without going to Court if they enter a "Part VIIIAB financial agreement". For more information see particularly Part VIIIAB of the Act, comprising sections 90RA onwards. Section 90UD authorises "Financial Agreements after the breakdown of a de facto relationship".
Participating jurisdictions include NSW, Victoria, QLD, Tasmania, ACT and NT.
